decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.

  1. Il pubblico dibattimento, già fissato per il 5 febbraio 2004 alle ore 10:15 non avrà quindi luogo; l'incarto è ritornato al per quanto di sua competenza.
