The Pretura penale in Bellinzona dealt with two objections against criminal decrees. After defense counsel withdrew the objections, the single judge struck the proceedings from the docket, declared the decrees enforceable, and sent the files back to the public prosecutor. Court costs of CHF 80 were imposed on the objector.
Art. 210-211 CPP; withdrawal of objection against a criminal decree: once the objection is withdrawn, the objection proceedings are discontinued, the file is struck off the roll, and the decree of accusation becomes enforceable. The court may allocate the costs of the discontinuance to the objecting party.
