Omnilex summary

The accused filed an objection to a penal decree of accusation issued on 2002-07-15, but later withdrew it by counsel’s letter dated 2004-09-28. The Pretura penale, sitting through Judge Marco Ambrosini, took note of the withdrawal, struck the proceedings from the docket, declared the decree of accusation enforceable, and cancelled the already scheduled public hearing. No fees or costs were charged for this order.

Omnilex headnote

Arts. 210 and 211 CPP; withdrawal of objection to a penal decree of accusation; once the objection is withdrawn, the court strikes the proceeding from the roll and the decree of accusation becomes enforceable.
