Summary

The defendant withdrew his opposition to a decree of accusation. The Pretura penale therefore struck the proceeding from the docket, declared the decree enforceable, cancelled the already scheduled public hearing, and ordered that no court fees or costs be charged. Arts. 210-211 CPP; withdrawal of opposition to a decree of accusation; procedural consequences. Upon withdrawal of an objection against a decree of accusation, the objection proceeding becomes devoid of object and is to be struck from the docket ex officio; the decree of accusation acquires enforceability. Any hearing already scheduled on the opposition is cancelled as unnecessary. Unless otherwise provided, no procedural costs are levied where the court expressly orders the proceeding closed without fees (consid. implicit).
