Die Wahrung der dreimonatigen Frist gemäss § 246 Ziff. 2 ZPO ist nachzuweisen und nicht nur glaubhaft zu machen

§ 246 Ziff. 2 aZPO (TG)

1. Der Gesuchsteller machte einen Revisionsgrund nach § 246 Ziff. 2 lit. a ZPO geltend. Es stellt sich die Frage, ob die dreimonatige Frist eingehalten ist.

2. Eine die Frist in Lauf setzende Kenntnis des Revisionsgrundes ist vorhanden, sobald ein auf sicherer Grundlage und nicht bloss vagen Anhaltspunkten beruhendes Wissen gegeben ist, auch wenn noch kein sicherer Beweis vorliegt (BGE 95 II 286; Frank/ Sträuli/Messmer, Kommentar zur zürcherischen Zivilprozessordnung, 3.A., § 295 N 1; Leuch/Marbach/Kellerhals, Die Zivilprozessordnung für den Kanton Bern, 4.A., Art. 369 N 1b). Die Frage, ob die Fristeinhaltung vom Gesuchsteller nachzuweisen oder nur glaubhaft zu machen ist, wird im thurgauischen Recht nicht ausdrücklich geregelt. Nach zürcherischem Recht ist nachzuweisen und nicht nur glaubhaft zu machen, dass das Revisionsbegehren rechtzeitig gestellt wurde (§ 296 Abs. 1 Ziff. 4 ZPO ZH; Frank/ Sträuli/Messmer, § 296 ZPO N 3). Für das thurgauische Recht muss der gleiche Grundsatz gelten, was schon aus § 247 Satz 2 ZPO folgt, wonach das Revisionsgesuch die vom Revisionskläger geltend gemachten Revisionsgründe und die Bezeichnung der für die Rechtfertigung des Begehrens erforderlichen Beweise enthalten muss.
