Einem nach Ablauf der Rechtsmittelfrist gestellten Gesuch um aufschiebende Wirkung kann nicht mehr stattgegeben werden

Innert der Rechtsmittelfrist sind nicht nur die Anträge zu stellen und eine Begründung zu liefern; innerhalb dieser Zeitspanne ist ferner auch um aufschiebende Wirkung zu ersuchen. Dies ergibt sich zum einen aus dem Sinn und Zweck eines dahingehenden Begehrens. Zum anderen kann einer betreibungs- resp. konkursrechtlichen Beschwerde nach Ablauf der Beschwerdefrist nicht von Amtes wegen sistierende Wirkung zuerkannt werden (Brügger, Die schweizerische Gerichtspraxis im Schuldbetreibungs- und Konkursrecht 1946-1984, Art. 36 SchKG N 4). Wenn die Behörde nicht befugt ist, im nachhinein dem Rechtsmittel die aufschiebende Wirkung zu erteilen, muss indessen sinngemäss dasselbe für den Beschwerdeführer bzw. Rekurrenten gelten: Um aufschiebende Wirkung kann er wohl schon vor Beginn der Rechtsmittelfrist (BGE 85 III 150), nicht aber nach Ablauf derselben ersuchen, bzw. es darf einem dahingehenden Begehren alsdann nicht mehr stattgegeben werden.
