Fürsorgerische Freiheitsentziehung: Unterliegt die Gemeinde im gerichtlichen Verfahren, sind ihr keine Verfahrenskosten zu überbinden

1. X war gestützt auf einen Beschluss der Vormundschaftsbehörde fürsorgerisch die Freiheit entzogen worden. Sein Begehren um Entlassung aus der Klinik wies das Gerichtspräsidium ab. Die Rekurskommission schützte den Rekurs von X und wies die Streitsache zwecks Einholung eines Gutachtens an die Vorinstanz zurück.

2. Dieser Ausgang des Verfahrens hätte konstanter Praxis entsprechend zur Folge (RBOG 1970 Nr. 16), dass dem Rekurrenten für die heutigen amtlichen Kosten einstweilen der Rückgriff auf die Gemeinde gewährt wird, und dass die Parteikosten bei der Hauptsache bleiben.

Ein Verzicht auf Kostenüberbindung ist zwar gemäss gesetzlicher Vorschrift nur vorgesehen, wenn der Kanton finanziell belastet werden müsste (§ 1 Abs. 4 der Verordnung des Grossen Rates über die Gebühren der Strafuntersuchungs- und Gerichtsbehörden). In Belangen des fürsorgerischen Freiheitsentzugs, wo die Gemeinden den ihnen vom Bundesrecht auferlegten Verpflichtungen nachzukommen haben, scheint es jedoch angebracht, in analoger Anwendung dieser Bestimmung im Falle ihres Unterliegens auf die Erhebung amtlicher Kosten zu verzichten. Hingegen ist die Gemeinde dann, wenn dem Begehren um Entlassung aus dem fürsorgerischen Freiheitsentzug letztlich stattgegeben wird, verpflichtet, X sowohl für das Verfahren vor dem Gerichtspräsidium als auch vor der Rekurskommission angemessen zu entschädigen (§ 75 Abs. 1 ZPO).
