(Berufung gegen die Verfügung des Einzelrichters am Bezirksgericht Einsiedeln vom 17. September 2019, ZET 2019 124);-

hat der Kantonsgerichtspräsident,

nachdem sich ergeben und in Erwägung:

  • dass B.________ mit Schreiben vom 2. Oktober 2019 (KG-act. 9) seine eigene Berufung und mit Schreiben vom 14. Oktober 2019 (KG-act. 11) jene seines Bruders A.________ als dessen Vertreter zurückgezogen hat, weshalb das Verfahren gestützt auf Art. 241 Abs. 3 ZPO abzuschreiben ist;

  • dass bei diesem Ausgang des Verfahrens die Gerichtskosten gestützt auf Art. 106 Abs. 1 ZPO den Berufungsführern aufzuerlegen sind;

  • dass gestützt auf Art. 95 Abs. 3 lit. c den nicht anwaltlich vertretenen Berufungsgegnern mangels Begründung keine Parteientschädigung zuzusprechen ist;

  • dass die Abschreibung des Verfahrens gestützt auf § 40 Abs. 2 JG in die Kompetenz des Präsidenten fällt;-

verfügt:

1. Das Berufungsverfahren wird abgeschrieben.

2. Die zweitinstanzlichen Kosten von Fr. 300.00 werden den Berufungsführern unter solidarischer Haftung auferlegt.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach

Massgabe von Art. 72 ff. des Bundesgerichtsgesetzes *Beschwerde in Zivilsachen * beim Bundesgericht in Lausanne eingereicht werden; die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen. Der Streitwert ist unbestimmt.

4. Zufertigung an die Parteien bzw. ihren Vertreter (je 1/R, an jene mit Wohnsitz in Deutschland auf dem Rechtshilfeweg, je unter Beilage einer Kopie von KG-act. 9 und 11 an die Berufungsgegner), die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, mit den Akten) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
