Omnilex summary

The appellant withdrew her appeal against the March District Court’s order on testament opening. The Schwyz Cantonal Court President therefore discontinued the appeal proceedings. The second-instance costs of CHF 200 were imposed on the appellant, while no party compensation was awarded because the respondents had incurred no compensable expenses. The order was issued by the Cantonal Court President, who had competence to discontinue the proceedings.

Omnilex headnote

Art. 241 Abs. 3 ZPO; withdrawal of appeal and discontinuance of proceedings; Art. 106 Abs. 1 ZPO; cost consequences after withdrawal. Upon valid withdrawal of an appeal, the appellate proceedings are to be struck off the roll. Costs are generally borne by the party causing discontinuance. If the opposing party incurred no compensable expenditure, no party indemnity is due. The competence to issue the discontinuance order may rest with the court president where cantonal law so provides (§ 40 Abs. 2 JG).

Key legal question

Whether the appeal proceedings had to be discontinued after withdrawal of the appeal.

Extracted holding

Yes. The withdrawal of the appeal required the proceedings to be struck off the docket.

Extracted reasoning

Because the appellant withdrew her appeal by letter, the court discontinued the case under Art. 241(3) CCP.

Key legal question

How the second-instance costs should be allocated after withdrawal of the appeal.

Extracted holding

The second-instance court costs were charged to the appellant.

Extracted reasoning

Under Art. 106(1) CCP, the costs follow the outcome; since the appellant withdrew, she must bear the costs.

Key legal question

Whether party compensation was due to the respondents.

Extracted holding

No party compensation was awarded.

Extracted reasoning

The respondents incurred no compensable expenses from the appeal, so no indemnity was granted.
