hat der Kantonsgerichtspräsident,

nachdem sich ergeben und in Erwägung:

  • dass das Strafgericht Schwyz mit Urteil vom 11. Oktober 2019 im Verfahren SGO 2018 25 den Beschuldigten B.________ des mehrfachen Betrugs und des mehrfachen versuchten Betrugs im Sinne von Art. 146 Abs. 1 StGB zum Nachteil der kantonalen Arbeitslosenkasse St. Gallen sowie der mehrfachen Ausnützung einer Notlage im Sinne von Art. 193 Abs. 1 StGB zum Nachteil von E.________ schuldig sprach, ihn als Zusatzstrafe zum Urteil des Kantonsgerichts Schwyz vom 20. Juni 2017 mit einer Freiheitsstrafe von 18 Monaten unbedingt bestrafte, die Genugtuungsforderung von E.________ im Betrage von Fr. 5'000.00 nebst Zins guthiess und im Übrigen abwies sowie die Herausgabe der beschlagnahmten Gegenstände und die Verfahrenskosten regelte,

  • dass die kantonale Staatsanwaltschaft mit Zustimmung der Oberstaatsanwaltschaft gegen das im Dispositiv eröffnete Urteil am 22./24 Oktober 2019 fristgerecht Berufung angemeldet hat (Art. 399 Abs. 1 StPO) und ihnen das begründete Urteil am 17. bzw. 20. April 2020 zugestellt wurde (KG-act. 5);

  • dass innert der zwanzigtägigen Frist von Art. 399 Abs. 3 StPO, welche spätestens am Montag, 11. Mai 2020 endete, keine Berufungserklärung eingegangen ist;

  • dass die Befristungen für Berufungsanmeldung und -erklärung Gültigkeitsvorschriften sind, sodass zur gültigen Einlegung einer Berufung der diesbezügliche Wille zweimal zu erklären ist, abgesehen vom Fall, in welchem ein Urteil direkt begründet zugestellt wird (BGE 138 IV 157 , E. 2.1 f.; Luzius Eugster, in: Basler Kommentar StPO, 2. Auflage, Art. 399 N 1 StPO; Markus Hug, in: Donatsch/Hansjakob/Lieber, Kommentar zur Schweizerischen Strafprozessordnung, Art. 399 N 10 f.; a.M. Schmid StPO PK, Art. 399 N 10 f. und 403 N 4);

  • dass damit die Berufung zwar angemeldet, aber nicht erklärt worden ist, was auf einen nachträglichen Verzicht hinausläuft, weshalb praxisgemäss nicht nach Art. 403 Abs. 1 lit. a und Abs. 3 StPO zu verfahren, sondern die Berufung im Verfahren nach § 40 Abs. 2 JG präsidial abzuschreiben ist (Art. 386 StPO und STK 2012 22 vom 7. Mai 2012);

  • dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen und Entschädigungen mangels Aufwands nicht zu sprechen sind;-

verfügt:

1. Die Berufung wird als durch Verzicht auf Berufungserklärung erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an die kantonale Staatsanwaltschaft (1/A), die Oberstaatsanwaltschaft (1/R), Rechtsanwalt D.________ und Rechtsanwalt C.________ (je 2/R), Rechtsanwältin F.________ (2/R), die Vorinstanz (1/ü) sowie nach definitiver Erledigung an die Vorinstanz (1/ES; die Rückgabe der Akten erfolgt nach Erledigung aller Berufungen) und an die Kantonsgerichtskasse (1/ü im Dispositiv).
