Omnilex summary

The Schwyz cantonal court held that the prosecution had timely filed an appeal notice against the district court judgment but failed to submit an appeal declaration within the statutory 20-day period after service of the motivated judgment. The omission was treated as a waiver, so the appeal was written off by presidential order rather than dealt with under the ordinary appellate provisions. Second-instance costs of CHF 300 were imposed on the state, and no compensation was awarded.

Omnilex headnote

Art. 399 Abs. 1 and 3 StPO; validity requirements for appeal notice and appeal declaration; where the appellant timely gives notice of appeal but omits the appeal declaration after service of the motivated judgment, the appeal is deemed waived and is to be written off ex officio in a presidential procedure. The time limits are formal validity requirements; the right to appeal is preserved only by two distinct declarations of intent, except where the motivated judgment is served directly (consid. related to the deadline analysis). Art. 386 StPO governs the procedural consequence. Costs follow the outcome; compensation is denied absent compensable effort.

Key legal question

Whether the prosecution's appeal had to be written off because no appeal declaration was filed on time.

Extracted holding

Yes. The appeal was filed by notice but not perfected by a timely appeal declaration, which amounts to a later waiver.

Extracted reasoning

The deadlines for appeal notice and appeal declaration are validity requirements. Because no declaration was filed within the 20-day period, the appeal could not proceed and was to be written off in a presidential procedure rather than handled under Art. 403 StPO.

Key legal question

Allocation of second-instance court costs and entitlement to compensation.

Extracted holding

The second-instance court costs are borne by the state, and no compensation is awarded because no expense was incurred.

Extracted reasoning

Given the outcome of the proceeding, costs fall on the state and there is no basis for compensation in the absence of compensable effort.
