gegen

betreffend

üble Nachrede, Hausfriedensbruch

(Berufung gegen das Urteil des Bezirksgerichts March vom 5. September 2018, SGO 2018 5);-

hat die Kantonsgerichtsvizepräsidentin,

nachdem sich ergeben und in Erwägung:

  • dass der Beschuldigte gegen das Urteil des Bezirksgerichts March vom 5. September 2018 laut Aktennotiz telefonisch am 11. September 2018 die Berufung anmeldete (Art. 399 Abs. 1 StPO; Vi-act. 35) und innert Frist am 27. Januar 2019 Berufung (Art. 399 Abs. 3 StPO) erklärte;

  • dass der Beschuldigte mit bei der Post am 25. September 2019 aufgegebenem Schreiben dem Kantonsgericht den Rückzug der Berufung bekannt gab (Art. 386 Abs. 2 StPO);

  • dass demnach die angesetzte Berufungsverhandlung entfällt und das Verfahren vor Kantonsgericht zufolge Rückzugs der Berufung präsidial nach § 40 Abs. 2 i.V.m. § 41 Abs. 1 JG abzuschreiben ist;

  • dass zufolge Abschreibung offengelassen werden kann, ob die nicht in persönlicher Anwesenheit bzw. Vorsprache, sondern nur telefonisch erstattete Berufungsanmeldung dem Formerfordernis des mündlichen Zuprotokollgebens (vgl. Riklin, OFK, 2. A. 2014, Art. 110 StPO N 2) im Sinne von Art. 399 Abs. 1 i.V.m. Art. 110 Abs. 1 StPO genügt, wenn Art. 66 StPO von einer Mündlichkeit des Verfahrens in Anwesenheit der Parteien vor den Strafbehörden ausgeht (vgl. etwa Hafner/Fischer, BSK, 2. A. 2014, Art. 110 StPO N 3 f.);

  • dass zufolge Abschreibung der Berufung das Bezirksgericht zur Auskunft über den Lauf der Probezeit zuständig ist (Art. 44 Abs. 3 StGB);

  • dass auf Erhebung von Gerichtskosten verzichtet wird und keine Entschädigung zu sprechen ist;-

verfügt:

1. Die Berufung wird durch Rückzug als erledigt abgeschrieben.

2. Es werden keine Kosten erhoben.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes Beschwerde in Strafsachen beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an den Beschuldigten (1/R) sowie an die Oberstaatsanwaltschaft (1/R), die Privatklägerin (1/R) und an die Staatsanwaltschaft March (1/A), je unter Beilage einer Kopie des Rückzugs der Berufung vom 25. September 2019 und die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Aktenrückgabe und zur Mitteilung an die KOST).
