Omnilex summary

The Schwyz Cantonal Court discontinued the prosecution's appeal against the first-instance criminal judgment because, although the notice of appeal was filed in time, no appeal declaration was submitted within the statutory period. The court treated this as a later waiver rather than a case for the formal withdrawal procedure. It ordered second-instance costs of CHF 300 to be borne by the state and declined to award any compensation.

Omnilex headnote

Art. 399 Abs. 1 und 3 StPO; appeal notice and appeal declaration as separate validity requirements. An appeal is validly initiated only if both declarations are made within the statutory framework, unless the judgment is served with reasons directly. Where a timely notice of appeal is followed by no appeal declaration, this constitutes a subsequent waiver of the appeal. In such a case the appeal is not to be dealt with under Art. 403 StPO, but is to be administratively struck off/discontinued by the presiding judge pursuant to the applicable cantonal procedural provisions in conjunction with Art. 386 StPO (consid. 2). If the appeal is discontinued without substantive proceedings, court costs may be charged to the state and no compensation is awarded absent expenses (consid. 3).

Key legal question

Whether the prosecution's appeal had to be discontinued because no appeal declaration was filed after the notice of appeal.

Extracted holding

The appeal was filed but not declared within the deadline; this amounted to a subsequent waiver, so the appeal was discontinued.

Extracted reasoning

The court held that notice of appeal and appeal declaration are separate validity requirements. Since only the notice was filed and no declaration followed, the appeal could not proceed and had to be struck off procedurally.

Key legal question

How the second-instance costs should be allocated.

Extracted holding

The second-instance court costs were charged to the state and no compensation was awarded.

Extracted reasoning

Because the appeal was discontinued without substantive proceedings, the court found no basis to award compensation, and the costs fell on the state.
