hat der Kantonsgerichtspräsident,

nachdem sich ergeben und in Erwägung:

  • dass der Beschuldigte durch seinen Verteidiger gegen das Urteil des Einzelrichters am Bezirksgericht Schwyz vom 21. September 2018 innert Frist am 1. Oktober 2018 Berufung anmelden (KG-act. 2) und am 3. Dezember 2018 Berufung erklären liess (KG act. 3; Art. 399 StPO);

  • dass die Staatsanwaltschaft Innerschwyz am 13. Dezember 2018 Anschlussberufung erklärte (KG-act. 5);

  • dass der Beschuldigte einen Tag vor der Berufungsverhandlung am 16. September 2019 dem Kantonsgericht die angemeldete und erklärte Berufung zurückziehen liess (KG-act. 12 f.);

  • dass ein Rechtsmittel gemäss Art. 386 Abs. 2 StPO im mündlichen Verfahren bis zum Abschluss der Parteiverhandlungen zurückgezogen werden kann und die Berufung demzufolge präsidial nach § 40 Abs. 2 JG abzuschreiben ist;

  • dass gemäss Art. 401 Abs. 3 StPO auch die Anschlussberufung dahinfällt, wenn die Berufung zurückgezogen oder auf sie nicht eingetreten wird;

  • dass die (reduzierten) Gerichtskosten der zweiten Instanz gestützt auf Art. 428 Abs. 1 StPO dem Beschuldigten aufzuerlegen sind;

  • dass der Beschuldigte den Privatkläger gestützt auf Art. 436 Abs. 1 i.V.m. 433 Abs. 1 lit. a StPO angemessen zu entschädigen hat, der vom Rechtsvertreter des Privatklägers geltend gemachte Aufwand von 6.33 Stunden als angemessen erscheint, der Stundenansatz jedoch auf das ortsübliche Mass von Fr. 250.00 zu kürzen ist, zumal es sich um eine einfache Sache handelte (vgl. § 13 lit. c StPO);-

verfügt:

1. Berufung und Anschlussberufung werden infolge Rückzugs der Berufung als erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Beschuldigten.

3. Der Beschuldigte ist verpflichtet, den Privatkläger mit Fr. 1‘742.05 zu entschädigen.

4. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

5. Zufertigung an Rechtsanwalt B.________ (2/R), die Staatsanwaltschaft Innerschwyz (1/A), die Oberstaatsanwaltschaft (1/R), Rechtsanwalt E.________ (2/R), die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten; zum Vollzug und zur Erstattung der Meldungen ans Amt für Migration des Kantons Schwyz, das Verkehrsamt des Kantons Schwyz und an die KOST) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
