vorsätzliche rechtswidrige Einreise und Aufenthalt und Ausübung einer nichtbewilligten Erwerbstätigkeit

(Berufung gegen das Urteil des Bezirksgerichts Höfe vom 5. Juli 2017, SEO 2017 4);-

hat der Kantonsgerichtspräsident,

nachdem sich ergeben und in Erwägung:

  • dass die Staatsanwaltschaft Höfe Einsiedeln gegen das im Dispositiv eröffnete Urteil des Bezirksgerichts Höfe vom 5. Juli 2017 am 14. Juli 2017 fristgerecht Berufung angemeldet hat (Art. 399 Abs. 1 StPO) und ihr das begründete Urteil am 25. August 2017 zugestellt wurde;

  • dass innert der zwanzigtägigen Frist von Art. 399 Abs. 3 StPO, welche am 14. September 2017 endete, keine Berufungserklärung eingegangen ist;

  • dass die Befristungen für Berufungsanmeldung und -erklärung Gültigkeitsvorschriften sind, sodass zur gültigen Einlegung einer Berufung der diesbezügliche Wille zweimal zu erklären ist, abgesehen vom Fall, in welchem ein Urteil direkt begründet zugestellt wird (BGE 138 IV 157 , E. 2.1 f.; Luzius Eugster, in: Basler Kommentar StPO, 2. Auflage, Art. 399 N 1 StPO; Markus Hug, in: Donatsch/Hansjakob/Lieber, Kommentar zur Schweizerischen Strafprozessordnung, Art. 399 N 10 f.; a.M. Schmid StPO PK, Art. 399 N 10 f. und 403 N 4);

  • dass damit die Berufung zwar angemeldet, aber nicht erklärt worden ist, was auf einen nachträglichen Verzicht hinausläuft, weshalb praxisgemäss nicht nach Art. 403 Abs. 1 lit. a und Abs. 3 StPO zu verfahren, sondern die Berufung im Verfahren nach § 40 Abs. 2 JG präsidial abzuschreiben ist (Art. 386 StPO und STK 2012 22 vom 7. Mai 2012);

  • dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen und Entschädigungen mangels Aufwands nicht zu sprechen sind;-

verfügt:

1. Die Berufung wird als durch Verzicht auf Berufungserklärung erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an Rechtsanwalt C.________ (2/R), die Oberstaatsanwaltschaft (1/R), die Staatsanwaltschaft Höfe Einsiedeln (1/A), die Vor-instanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R unter Rückgabe der Akten; zur Erstattung der Meldung an die KOST) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
