(Berufung gegen das Urteil des Bezirksgerichts March vom 8. Juni 2017, SGO 2017 2);-

hat der Kantonsgerichtsvizepräsident,

nachdem sich ergeben und in Erwägung:

  • dass die Privatklägerin gegen das im Dispositiv eröffnete Urteil des Bezirksgerichts March vom 8. Juni 2017 am 12. Juni 2017 fristgerecht Berufung anmeldete (Art. 399 Abs. 1 StPO) und ihr das begründete Urteil am 29. Juni 2017 zugestellt wurde (vgl. Zustellbeleg Vi-act. 34);

  • dass innert der zwanzigtägigen Frist von Art. 399 Abs. 3 StPO, welche am 19. Juli 2017 endete, keine Berufungserklärung einging;

  • dass die Befristungen für Berufungsanmeldung und -erklärung Gültigkeitsvorschriften sind, sodass zur gültigen Einlegung einer Berufung der diesbezügliche Wille zweimal zu erklären ist, abgesehen vom Fall, in welchem ein Urteil direkt begründet zugestellt wird (BGE 138 IV 157 , E. 2.1 f.; Luzius Eugster, in: Basler Kommentar StPO, 2. Auflage, Art. 399 N 1 StPO; Markus Hug, in: Donatsch/Hansjakob/Lieber, Kommentar zur Schweizerischen Strafprozessordnung, Art. 399 N 10 f.; a.M. Schmid StPO PK, Art. 399 N 10 f. und 403 N 4);

  • dass damit die Berufung zwar angemeldet, aber nicht erklärt wurde, was auf einen nachträglichen Verzicht hinausläuft, weshalb praxisgemäss nicht nach Art. 403 Abs. 1 lit. a und Abs. 3 StPO zu verfahren, sondern die Berufung im Verfahren nach § 40 Abs. 2 JG präsidial abzuschreiben ist (Art. 386 StPO und STK 2012 22 vom 7. Mai 2012);

  • dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen und Entschädigungen mangels Aufwands nicht zu sprechen sind;-

verfügt:

1. Die Berufung wird als durch Verzicht auf Berufungserklärung erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an Herrn Rechtsanwalt G.________ (2/R), Herrn Rechtsanwalt B.________ (2/R), die Oberstaatsanwaltschaft (1/R), die Staatsanwaltschaft March (1/A) und an die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten und zur Meldungen des Freispruchs an die KOST) sowie an die Kantonsgerichtskasse (1/ü, im Dispositiv).
