A.________, Gesuchstellerin und Beschwerdeführerin,

gegen

B.________ AG, Gesuchsgegnerin und Beschwerdegegnerin,

Konkursbegehren ohne vorgängige Betreibung (Art. 190 SchKG)

(Beschwerde gegen die Verfügung der Einzelrichterin am Bezirksgericht Schwyz vom 17. Juli 2018, ZES 2018 320);-

hat die Kantonsgerichtsvizepräsidentin,

nachdem sich ergeben und in Erwägung:

  • dass die Gesuchstellerin mit Eingabe vom 24. Juli 2018 beim Bezirksgericht Schwyz Beschwerde gegen die Verfügung der Einzelrichterin vom 17. Juli 2018 einreichte (KG-act. 2);

  • dass diese Eingabe nicht den Anforderungen an eine rechtsgenügende Rechtsmittelschrift im Sinne von Art. 321 ZPO entsprach, wonach eine Beschwerde schriftlich und begründet einzureichen ist und die Rechtsmitteleingabe insbesondere Anträge resp. Abänderungsbegehren hinsichtlich des erstinstanzlichen Entscheids zu enthalten und sich mit dem vorinstanzlichen Entscheid auseinanderzusetzen hat;

  • dass der Gesuchstellerin und Beschwerdeführerin (nachfolgend nur: Beschwerdeführerin) mit Verfügung vom 27. Juli 2018 Gelegenheit geboten wurde, ihre Eingabe innert (noch) laufender Rechtsmittelfrist zu verbessern mit dem Hinweis, dass im Säumnisfall auf das Rechtsmittel nicht eingetreten werde (KG-act. 3 Dispositivziffer 2), und die Beschwerdeführerin darüber

hinaus aufgefordert wurde, bis spätestens 13. August 2018 einen Kostenvorschuss von Fr. 750.00 zu leisten (KG-act. 3 Dispositivziffer 3);

  • dass die Verfügung vom 27. Juli 2018 der Beschwerdeführerin am 30. Juli 2018 zugestellt wurde (KG-act. 3, Track & Trace vom 7. August 2018);

  • dass die Beschwerdeführerin innert Rechtsmittelfrist sowie gesetzter Frist bzw. bis heute weder eine verbesserte Eingabe einreichte noch den Kostenvorschuss von Fr. 750.00 leistete;

  • dass mangels Einreichung einer verbesserten Rechtsschrift androhungsgemäss auf das Rechtsmittel präsidial (§ 40 Abs. 2 JG) nicht einzutreten ist;

  • dass somit auf eine Nachfristansetzung gemäss Art. 101 Abs. 3 ZPO den Kostenvorschuss betreffend verzichtet werden kann;

  • dass bei diesem Verfahrensausgang die (reduzierten) Gerichtskosten gestützt auf Art. 106 Abs. 1 ZPO der Beschwerdeführerin aufzuerlegen sind und mangels Aufwand keine Entschädigung an die Gegenpartei auszurichten ist;-

verfügt:

1. Auf die Beschwerde wird nicht eingetreten.

2. Die zweitinstanzlichen Kosten von Fr. 100.00 werden der Beschwerdeführerin auferlegt.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 72 ff. des Bundesgerichtsgesetzes (BGG) Beschwerde in Zivilsachen beim Bundesgericht in Lausanne eingereicht werden; die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen. Es handelt sich um eine Konkurssache.

4. Zufertigung an die Parteien (je 1/R) und die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
