Omnilex summary

The Schwyz Cantonal Court dealt with the prosecution's appeal against a criminal judgment of the District Court of Schwyz. Although the appeal was timely announced, no appeal statement was filed within the 20-day deadline after service of the reasoned judgment. The court held that this constituted a waiver of the appeal and ordered the appeal to be struck off presidially. Second-instance costs of CHF 300 were charged to the state, and no compensation was awarded.

Omnilex headnote

Art. 399 Abs. 1 and 3 StPO; requirement of timely appeal notice and appeal statement as validity requirements; where the appellant timely announces an appeal but fails to file the appeal statement within the statutory period after service of the reasoned judgment, the omission is treated as a waiver of the appeal. In such a case, the appeal is not handled under Art. 403 StPO as a non-entry decision, but is struck off presidially in accordance with cantonal practice and Art. 386 StPO (consid. on deadlines and legal effect of omission). Costs follow the outcome; where no substantive proceedings take place, no compensation is due.

Key legal question

Whether the prosecution's appeal had to be struck from the docket because no appeal statement was filed after the appeal was announced.

Extracted holding

The appeal was discontinued as withdrawn by omission of the appeal statement; the matter is administratively closed.

Extracted reasoning

The statutory deadlines for appeal notice and appeal statement are validity requirements. Since the prosecution only announced the appeal but did not file the appeal statement within the 20-day period, this amounts to a subsequent waiver. The appeal was therefore not to be handled under the formal non-entry procedure of Art. 403 StPO, but to be struck off presidially.

Key legal question

Who bears the costs of the second instance and whether compensation is due.

Extracted holding

The second-instance court costs are borne by the state, and no compensation is awarded due to lack of expense.

Extracted reasoning

Because the appeal was discontinued without substantive proceedings, the state bears the court costs and no party compensation is justified.
