SOG 1993 Nr. 43 **§ 8 und 9 KZG.*Voraussetzungen für die Auszahlung von Kinderzulagen an den Vormund. Gemäss § 7 lit. b in fine Kinderzulagengesetz (KZG) hat jene Person auf begründetes Gesuch hin Anspruch auf Ausrichtung der Zulage, die überwiegend für den Unterhalt des Kindes aufkommt. Laut § 8 Abs. 1 KZG haben Arbeitnehmer, die gerichtlich oder vertraglich festgelegte Unterhaltsbeiträge leisten müssen, dieselben durch Zulagen zu ergänzen, sofern der Richter keine abweichende Anordnung trifft. Nach Abs. 2 dieser Bestimmung sind die Zulagen der unterhaltsberechtigten Person direkt auszuzahlen. Bietet diese allerdings keine Gewähr für eine zweckmässige Verwendung der Zulagen, so sind diese dem Elternteil oder jener Person, Amtsstelle oder Stelle auf begründetes Gesuch hin auszuzahlen, welcher die Obhut des Kindes anvertraut ist (§ 9 KZG). Der beschwerdeführende Vormund des Kindes weist zurecht darauf hin, dass die zuständige Vormundschaftsbehörde aufsichtsrechtlich angewiesen worden ist, u.a. die Alimentenverwaltung durch ihn sicherzustellen. Unbestrittenermassen gehört dazu auch die Verwaltung allfälliger Kinderzulagen, da diese gemäss § 8 Abs. 1 KZG vom Kindsvater zusätzlich zu den monatlichen Unterhaltsbeiträgen geschuldet sind. Weil im vorliegenden Fall (gemäss den hier nicht interessierenden Erwägungen) eine Auszahlung der Zulagen sowohl an das Kind als auch an die leiblichen Eltern und den Stiefvater nicht in Frage kommt, bietet nur noch der Vormund Gewähr dafür, dass diese zweckmässig im Interesse des Kindes Verwendung finden. Bei grundsätzlicher Gutheissung eines Anspruchs auf Ausrichtung von Kinderzulagen zugunsten des Kindes sind diese also dessen Vormund auszuzahlen (§ 9 KZG). * Versicherungsgericht, Urteil vom 4.
