Agricultural-zone building requires zonality determination

Omnilex summary

The case concerned a planned dwelling in the agricultural zone after the amended planning legislation entered into force. The court held that the competent cantonal authority must always examine whether the project is zonally compliant or instead falls under the exception regime. A zonally compliant agricultural building does not require an exception permit under Art. 24 RPG; the municipal building authority may then issue only a declaratory decision on zonality. By contrast, if Art. 24 RPG applies, a constitutive exception decision is required.

Omnilex headnote

Art. 22, 24 RPG; Art. 16 RPV; § 38 PBG: building in the agricultural zone; distinction between zonal compliance and site dependence. For constructions outside the building zone, the cantonal specialist authority must in any event examine ex officio whether the project is zonally compliant under Art. 22 RPG or whether Art. 24 RPG applies; this triage is required by Art. 25(2) RPG and serves to prevent circumvention and ensure uniform application (consid. 2). If the project is zonally compliant, no exception permit under Art. 24 RPG is needed; the competent building authority then issues only a declaratory finding. Only where the project is not zonally compliant and depends on a site outside the building zone is a constitutive exceptional permit required.

* Verwaltungsgericht, Urteil vom 10. Key legal question

Whether the building department must determine in every case whether a project in the agricultural zone is zonally compliant or requires an exception permit.

Extracted holding

Yes. The competent cantonal authority must first classify the project; only if it is zonally compliant may the municipal building authority issue a declaratory finding, whereas projects requiring Art. 24 RPG need a constitutive exception permit.

Extracted reasoning

Under Art. 16 RPV and Art. 25(2) RPG, the canton must perform a triage function to prevent circumvention and ensure uniform application of federal planning law. The distinction between zonal compliance and site dependence is often difficult, so the cantonal review is mandatory.

Key legal question

Whether a zonally compliant agricultural building in the agricultural zone still requires an exception permit under Art. 24 RPG.

Extracted holding

No. For a building that is zonally compliant under Art. 22(2) RPG, an exception permit under Art. 24(1) RPG is not a prerequisite, even if cantonal law generally requires authorization.

Extracted reasoning

Where the agricultural zone has been designated under Art. 16 RPG and the building conforms to the zone, federal law treats it as a normal zonal building, not as an exceptional out-of-zone construction.
