Zur Frage, ob ein neuer Liquidator durch Zirkulationsbeschluss gewählt werden kann oder ob eine Gläubigerversammlung einzuberufen ist, äusserte sich die Aufsichtsbehörde über Schuldbetreibung und Konkurs wie folgt: Sämtliche 162 stimmberechtigten Gläubiger wurden mit eingeschriebenem Brief aufgefordert, innert 10 Tagen allfällige Einwendungen gegen die Niederlegung und Übertragung des Amtes des Liquidators anzumelden. Nachdem kein eingeschriebener Brief von der Post als unzustellbar zurückkam, kann davon ausgegangen werden, dass alle stimmberechtigten Gläubiger vom vorgesehenen Wechsel des Liquidators gehörig Kenntnis erhielten. Die grosse Mehrheit der stimmberechtigten Gläubiger mit einer weit überwiegenden Mehrheit der Forderungen hat gegen diesen Wechsel des Liquidators keine Einwendungen erhoben. Entgegen der Ansicht des Eidg. Amtes für Handels- und Güterrechtsregister vertritt die Aufsichtsbehörde des Kantons Solothurn die Meinung, dass ein Zirkulationsbeschluss der Gläubiger, anstelle eines Versammlungsbeschlusses, zulässig ist. Sie stützt sich dabei auf BGE 48 III 45; 54 III 118; 69 III 18; Praxis Jaeger zu Art. 235 N 10 und Art. 255 N 3 sowie Fritzsche II S. 160. Der Wahl von XY zum neuen Liquidator im Nachlassvertragsverfahren der Firma Z. in Nachlass-Liquidation, kann folglich die Genehmigung erteilt werden. Der vom bisherigen Liquidator beim Handelsregisteramt beantragte Eintragung eines Wechsels des Liquidators im Handelsregister steht nichts im Wege. * Aufsichtsbehörde für Schuldbetreibung und Konkurs, Urteil vom 12.
