In der Folge erklärte die Staatsanwaltschaft die Anschlussberufung bezüglich der Strafzumessung und verlangte eine höhere Strafe. Anlässlich der Berufungsverhandlung beantragte die Anschlussberufungsklägerin jedoch im Strafpunkt ausdrücklich eine Bestätigung des erstinstanzlichen Urteils. * Aus den Erwägungen:* 4. (…) Der Anschlussberufung kommt in gewissem Sinne der Charakter eines Druckmittels zu, mit dem der Berufungskläger zum Rückzug seines Rechtsmittels bewegt werden soll, zumal die Staatsanwaltschaft und teilweise auch die Privatklägerschaft mit der Anschlussberufung das Verbot der reformatio in peius aufheben können (Urteil des Bundesgerichts 6B_390/2012 vom 18. Februar 2013 E. 2.3.1). Eine solche für den Beschuldigten schwer wiegende Folge setzt voraus, dass die Anschlussberufungsklägerin zumindest eine Abänderung des angefochtenen Urteils beantragt. Wenn sich aber die Anklägerin – wie im vorliegenden Fall – an der Hauptverhandlung entgegen der ursprünglichen Erklärung damit begnügt, eine vollumfängliche Bestätigung des erstinstanzlichen Urteils zu verlangen, vermag sie nicht das Verschlechterungsverbot zu beseitigen. Ein solcher Antrag ist vielmehr als impliziter Rückzug der Anschlussberufung zu werten. Demzufolge verbleibt allein noch die zu Gunsten des Beschuldigten ergriffene Berufung, so dass gemäss Art. 391 Abs. 2 StPO das erstinstanzliche Urteil nicht zu dessen Lasten abgeändert werden darf. * Obergericht Strafkammer, Urteil vom 16.
