Omnilex summary

The court reconsidered its former practice on competence for release from early execution of a sentence when a criminal judgment is appealed to the Federal Supreme Court. In light of newer Federal Supreme Court case law, it held that the appellate court's case management authority remains competent to decide such release requests even during the federal appeal. Since early-execution release requests are to be treated like custody-release requests, the court entered into the application.

Omnilex headnote

Competence to decide release from early execution of sentence during a Federal Supreme Court appeal; the cantonal appellate court's case management authority remains competent throughout the federal appeal proceedings. Earlier practice assigning competence after conclusion of the cantonal appeal to the execution authority is no longer tenable. Requests for release from early execution are to be treated in the same manner as custody-release requests and must therefore be received and processed by the appellate court's case management (consid. 2b).

Key legal question

Which authority is competent to decide release from early execution of sentence while a Federal Supreme Court appeal is pending?

Extracted holding

The cantonal appellate court's case management authority remains competent to decide release requests even during the Federal Supreme Court proceedings.

Extracted reasoning

The court held that earlier cantonal practice had assigned competence after the appeal proceedings to the body responsible for prison execution, but newer Federal Supreme Court case law makes clear that the appellate court's case management retains competence during the federal appeal as well. Release requests from early execution must be treated like release requests from custody.
