Erwägungen

I.

  1. Am 23. März 2007 kündigte A (Verpächter) den mit B (Pächter) bestehenden Pachtvertrag betreffend zwei landwirtschaftliche Nutzflächen der Liegenschaft C fristlos, eventualiter vorzeitig auf den Herbsttermin (31.10.2007).

B weigert sich, die Pachtobjekte zurückzugeben.

  1. Am 27. Juli 2007 verlangte A vom Kreisgerichtspräsidenten die Feststellung der Gültigkeit der Kündigung und einen Räumungsbefehl sowie dessen Vollstreckung bei Eintritt der Rechtskraft desselben. B trug auf Abweisung der Klage an.

Mit Entscheid vom 24. August 2007 trat der Kreisgerichtspräsident auf die Klage mangels klaren Rechts nicht ein und auferlegte die Verfahrenskosten von Fr.500.- dem Kläger.

  1. Gegen diesen Entscheid erhob der Kläger mit Eingabe vom 7. September 2007 Rekurs beim Einzelrichter des Kantonsgerichts mit dem Antrag, dieser sei aufzuheben und die Sache zur materiellen Beurteilung an die Vorinstanz zurückzuweisen; eventualiter sei die Klage gutzuheissen.

Der Beklagte verzichtete auf eine Rekursantwort (telefonische Mitteilung vom 13.09.2007).

II.

Die von Amtes wegen vorzunehmende Prüfung der Prozessvoraussetzungen (Art. 79, 217 lit. a, 219 Abs. 1 ZPO; Art. 82 GerG) ergibt, dass diese erfüllt sind.

Auf den Rekurs ist einzutreten.

III.

  1. Nach Art. 197 lit. d ZPO gewährt der Richter für die Ausweisung eines Mieters oder Pächters raschen Rechsschutz. Nach dem klaren Wortlaut dieser Bestimmung brauchen als Voraussetzung für einen Entscheid in der Sache - anders als in Fällen gemäss Art. 197 lit. a ZPO - weder klares Recht noch liquide tatsächliche Verhältnisse vorzuliegen. Dies gilt für sämtliche Ausweisungsverfahren und damit auch für das vorliegende (vgl. auch LEUENBERGER/UFFER-TOBLER, Kommentar zur Zivilprozessordnung des Kantons St. Gallen, N 2 b und 7 a - c zu Art. 197 ZPO mit Hinweisen).

  2. Ist der Vorderrichter auf die Klage demnach zu Unrecht nicht eingetreten, ist der angefochtene Entscheid in Gutheissung des Rekurses aufzuheben und die Sache zur materiellen Behandlung zurückzuweisen.
