Erwägungen (Auszug)

IV. 2. b) Im Berufungsverfahren ist der Kläger demgegenüber durch einen Anwalt vertreten, der einen Berufungsentscheid unter Entschädigungsfolge zu Lasten des Beklagten beantragt; der Kläger ist daher zu entschädigen. Bei der Festlegung dieser Entschädigung fällt in Betracht, dass im Rechtsmittelverfahren in der Regel Art. 26 HonO mit einem Rahmen von 20-50% des nach dem Streitwert oder als Pauschalen bemessenen Honorars (rein schriftliches Rechtsmittelverfahren) bzw. 40-75% (Rechtsmittelverfahren mit Verhandlung) zu Anwendung gelangt. Diese Bestimmung ist aber auf Fälle zugeschnitten, in denen die betroffene Partei schon erstinstanzlich anwaltlich vertreten war, weshalb das Honorar im Rechtsmittelverfahren  angesichts des Umstands, dass der Rechtsvertreter die Streitigkeit bereits kennt, zu reduzieren ist. Für den Fall, in dem eine Partei den Anwalt erst im Rechtsmittelverfahren beizieht, stellt sich daher die Frage, ob nicht auf die Reduktion der Entschädigung zu verzichten wäre. Ein volles Honorar würde allerdings dem Umstand, dass der Aufwand im Rechtsmittelverfahren angesichts der Novenbeschränkung gemäss Art. 317 Abs. 1 ZPO (bzw. des Novenverbots gemäss Art. 326 Abs. 1 ZPO) und der Begrenzung des Streitgegenstands auf die Auseinandersetzung mit dem Entscheid der Vorinstanz resp. die diesbezüglichen Ausführungen der Gegenpartei regelmässig geringer als im erstinstanzlichen Verfahren ausfällt, zu wenig Rechnung tragen. In einem solchen aus Sicht des Anwalts "unvollständigen Prozess" gelangt daher Art. 27 Abs. 1 lit. d HonO zur Anwendung. Danach beträgt das Honorar eines Rechtsvertreters, welcher erst im Rechtsmittelverfahren beteiligt war, bis zu neun Zehntel des Grundhonorars.
