Omnilex summary

The court held that a respondent in an appeal may request security for party costs for the first time in the appeal response because Art. 99 ZPO sets no deadline and no forfeiture. In appeal proceedings, the costs of preparing the response may be included when the request is made at that point. The court further stated that employment disputes up to CHF 30,000 are not excluded from the security regime: they are pecuniary disputes under Art. 243(1) ZPO and remain subject to Art. 99 ZPO.

Omnilex headnote

Art. 99 ZPO; request for security for party costs in appeal proceedings and applicability to employment disputes; the provision does not prescribe a time limit for the respondent’s application and does not provide forfeiture for late filing. A request lodged together with the appeal response is therefore admissible. In appeal proceedings, the costs incurred in drafting the response may be included in the security assessment when the request is made at that stage. Employment disputes are not governed by Art. 243(2) ZPO; as pecuniary disputes under Art. 243(1) ZPO they remain subject to simplified proceedings up to CHF 30,000, and Art. 99(3)(a) ZPO does not exempt them from the duty to provide security.

(…)

Key legal question

Whether a request for security for party costs under Art. 99 ZPO must be filed at a specific time in appeal proceedings

Extracted holding

Art. 99 ZPO does not specify a deadline for the respondent's request, and the ZPO provides no forfeiture if the request is not made earlier; the request may be made in the appeal response.

Extracted reasoning

The statute contains no temporal rule and no sanction for late filing. Therefore, a request submitted together with the appeal response is admissible.

Key legal question

Whether security for costs may cover expenses already incurred, including work on the appeal response

Extracted holding

As a rule, security covers only future costs, but in appeal proceedings the costs of preparing the appeal response may be taken into account when the security request is filed together with the response.

Extracted reasoning

Although prior expenses are generally not covered, this situation is treated differently in appeal proceedings because the respondent's response work is already incurred when the request is made.

Key legal question

Whether employment disputes below CHF 30,000 are excluded from security for party costs

Extracted holding

Employment disputes are not covered by Art. 243(2) ZPO; as pecuniary disputes under Art. 243(1) ZPO they fall under simplified procedure up to CHF 30,000, and Art. 99(3)(a) ZPO expressly excludes only the matters listed there, so the security rule of Art. 99 ZPO applies.

Extracted reasoning

The doctrine is unanimous that these disputes remain under Art. 243(1) ZPO. Because Art. 99(3)(a) ZPO excludes only the cases it expressly mentions, employment disputes up to CHF 30,000 are not exempt from security.
