Omnilex summary

The Regierungsrat held that development cost contributions under Art. 21 lit. f BauG are special charges compensating the increase in value of land caused by a public improvement. They must be value-equivalent, meaning they may not exceed the individual special benefit, and the municipality's total expenditure for the work sets the upper limit. The decision notes that this ceiling is taken into account in the relevant regulation.

Omnilex headnote

Key legal question

What is the legal nature of development cost contributions under Art. 21 lit. f BauG?

Extracted holding

They are special charges intended to offset the increase in value a parcel receives from a public improvement.

Extracted reasoning

The contribution is tied to the individual special benefit created by the public work and is not a general tax.

Key legal question

How far may development cost contributions be assessed?

Extracted holding

They must correspond to the individual special benefit and may not exceed the municipality's expenditure for the work; the maximum of all contributions is reflected in the regulation.

Extracted reasoning

Value adequacy is required, so the charge is limited by the benefit conferred and by the overall cost ceiling.
