Der Beschwerdeführer rügt, der Gemeinderat habe mit ihm vor der Wahl keine Fühlung aufgenommen. Eine Pflicht, vor der Wahl in ein Nebenamt die betroffene Person zu befragen, ist jedoch mit Art. 23 KV nicht in Einklang zu bringen. Die vorgängige Anfrage ist wohl ein Gebot der Höflichkeit, aber keine Rechtspflicht.
Es bleibt noch zu untersuchen, ob der Einwohnergemeinderat von einer falschen Auslegung von Art. 23 Abs. 1 KV ausgegangen und der Beschluss demzufolge von der Beschwerdeinstanz aufzuheben sei. Art. 23 KV steht unter dem klaren Marginale "Amtszwang". Ebenso deutlich ist der Wortlaut des Artikels. Unter dem Begriff "Amt" sind hier verständlicherweise nur Nebenämter gemeint, was auch aus dem Verfassungsprotokoll hervorgeht. Das Amt eines Mitgliedes der Wasserversorgungskommission wird zweifellos von dieser Bestimmung erfasst, handelt es sich doch um ein Nebenamt, dessen Träger der Einwohnergemeinderat in freier Wahl bestellt. Die verfassungsrechtliche Bestimmung über den Amtszwang gelangt also auch in casu zur Anwendung und trifft für den Beschwerdeführer zu; die Befreiungsgründe, die in Art. 23 Abs. 2 KV abschliessend aufgezählt sind können vom Beschwerdeführer nicht geltend gemacht werden. Die von ihm geforderte "sinnvolle" Interpretation, wonach die berufliche Belastung ebenfalls zu berücksichtigen wäre, ist angesicht der abschliessenden Aufzählung der Befreiungsgründe ausgeschlossen, ganz abgesehen davon, dass für Verfassungsinterpretationen nicht der Regierungsrat, sondern der Kantonsrat zuständig ist.
