Omnilex summary

The Regierungsrat held that sufficient road access is a condition for a building permit under Art. 4 BauG. In assessing whether access is sufficient, it is immaterial whether the access road belongs to one owner or several. The only relevant factor is whether the currently usable carriageway can accommodate the additional burden caused by the proposed construction.

Omnilex headnote

Art. 4 BauG; sufficient road access as a condition for a building permit; the ownership structure of the access road is irrelevant. For the assessment of sufficient access, only the present factual usability of the carriageway is decisive, namely whether the road surface that can actually be used is capable of bearing the additional traffic load occasioned by the project. Whether the road is in the hands of one or several owners does not affect this test (consid. not indicated).

Entscheidpublikation VVGE 1971/75 Nr. 66, S. 71:

Art. 4 BauG.

Genügende Erschliessung durch Strasse als Voraussetzung der Baubewilligung.

Entscheid des Regierungsrates vom 31. August 1971 (Nr. 595).
