Kassation einer Gemeindeabstimmung wegen verspäteter Urnenöffnung.

Entscheid des Regierungsrates vom 16. Juli 1974 (Nr. 323).

Gemäss Lehre und Praxis stellt die verspätete Urnenöffnung einen typischen Kassationsgrund dar. Doch bewirkt das Vorliegen dieses Kassationsgrundes an sich nicht schon ohne weiteres die Ungültigkeit der Abstimmung. Vielmehr ist die Ungültigkeit bloss dann auszusprechen, wenn der Kassationsgrund auf den Ausgang der Abstimmung einen entscheidenden Einfluss gehabt hat oder hätte haben können, mit anderen Worten, wenn bei seiner Vermeidung ein anderer Ausgang der Abstimmung möglich gewesen wäre (vgl. RRB vom 8. September 1970 i.S. Gemeindeversammlungsbeschluss Giswil; Vico Picenoni: Die Kassation von Volkswahlen und Volksabstimmungen, 1945, S. 18 ff.). Auch das Bundesgericht fordert zwar nicht den Beweis, dass die fraglichen Unregelmässigkeiten das Wahlergebnis tatsächlich beeinflusst haben, doch muss der Sachverhalt dies mindestens als äusserste Annahme zulassen (vgl. BGE 97 I 663). Gemäss Art. 54 Abs. 2 AG müssen Verfahrensmängel von entscheidenem Einfluss auf das Ergebnis der Abstimmung gewesen sein oder sein können.

Die verspätete Urnenöffnung stellt eine rechtliche Vermutung (praesumptio iuris) eines erheblichen Kassationsgrundes dar. Aus der im einzelnen Fall festzustellenden faktischen Erheblichkeit ist damit eine generelle rechtliche gemacht worden, indem beim Vorliegen gewisser Tatsachen die Ungültigkeit des Wahlaktes - ohne die tatsächliche Erheblichkeit untersuchen zu müssen - von vorneherein vermutet wird (Picenoni a.a.O., S. 150). Diese rechtliche Vermutung könnte nur durch einen strikten Gegenbeweis umgestürzt werden. Diesen Gegenbeweis konnte der Gemeinderat im vorliegenden Fall nicht erbringen. Tatsächlich bestand die Möglichkeit, und das genügt, dass der Fehler geeignet war, einen wesentlichen Einfluss auf das Abstimmungsergebnis auszuüben.
