Beeinträchtigung des Landschaftsbildes durch standortbedingte Bauten.

Entscheid des Regierungsrates vom 19. September 1972 (Nr. 661).

Wie sich aus den Akten ergibt, handelt es sich beim geplanten Bauobjekt um ein Zweifamilienhaus für den in der Landwirtschaft des Vaters tätigen, verheirateten Sohn sowie für die landwirtschaftlichen Dienstboten. Der landwirtschaftliche Charakter des Objektes ist somit unbestritten, weshalb die Ausnahmebestimmung von Art. 4 Abs. 3 BMR ohne weiteres zur Anwendung gelangen kann.

Die sogenannten "standortbedingten Bauten" haben in baulicher Hinsicht einzig und allein die Bedingung zu erfüllen, dass sie das Landschaftsbild nicht beeinträchtigen dürfen. In casu handelt es sich beim Wohnhaus um eine gefällige, chaletartige Holzkonstruktion, die sich gut in die rein ländliche Umgebung einfügen wird, sodass irgendwelche Bedenken bezüglich Beeinträchtigung des Landschaftsbildes nicht bestehen. Weitere bauliche Vorschriften in bezug auf standortbedingte Bauten werden vom Gesetzgeber nicht gemacht. Insbesondere fehlt es an einer Bestimmung, wonach in einer landwirtschaftlichen Wohnbaute keine Dienstwohnung errichtet werden darf. Die von der Raumplanungskommission diesbezüglich gemachte Modifikation, die zweifelsohne eine erhebliche Einschränkung der Eigentumsfreiheit bedeuten würde, ist somit mangels gesetzlicher Grundlage unhaltbar; ganz abgesehen davon, dass es vom raumplanerischen Gesichtspunkt aus irrelevant ist, ob ein Objekt zwei kleinere, abgeschlossene Wohnungen enthält oder ob aber das ganze Objekt als Einfamilienhaus mit verschiedenen Dienstbotenräumen (inkl. sanitarische Installationen) ausgestaltet wird. Überdies ist vorliegend auch die Befürchtung der kantonalen Raumplanungskommission, wonach es "unvermeidlich wäre, dass die zweite Wohnung als Ferienwohnung verwendet würde", durch nichts erhärtet.
