Umfang der Überprüfungspflicht und Akteneinsichtsrecht der Rechnungsprüfungskommission.

Entscheid des Regierungsrates vom 12. Januar 1971 (Nr. 1135).

Gemäss Art. 85 Abs. 2 KV obliegt der Rechnungsprüfungskommission "die Prüfung des Finanzhaushaltes, insbesondere der Gemeinderechnungen, und die Antragstellung an die Gemeindeversammlung". Mit dieser klar abgegrenzten Umschreibung der Obliegenheiten wollte vom Gesetzgeber eindeutig zum Ausdruck gebracht werden, dass es sich beim neugeschaffenen selbständigen Gemeindeorgan nicht um eine Geschäftsprüfungskommission, sondern tatsächlich um eine Rechnungsprüfungskommmission handeln soll (vgl. Verfassungsprotokoll, S. 240 ff.). Damit jedoch dieser Kommission die Erfüllung ihrer umfangreichen und verantwortungsvollen Aufgabe ermöglicht wird, erhellt es ohne weiteres, dass ihr von den zuständigen Gemeindeinstanzen sämtliche notwendigen und sachbezüglichen Unterlagen zur Verfügung zu stellen sind. Insbesondere ist der Rechnungsprüfungskommission über sämtliche Beschlüsse, die das Finanzwesen betreffen, Aufschluss zu geben, sei es, dass solche Gemeinderatsbeschlüsse der Rechnungsprüfungskommission direkt zugestellt werden oder aber entsprechende Auszüge aus dem Ratsprotokoll auf der Gemeindekanzlei jederzeit zur Einsicht der Rechnungsprüfungskommission bereit gehalten werden. Eine Notwendigkeit zur uneingeschränkten Einsichtnahme in das Gemeinderatsprotokoll als solches besteht daneben nicht. Eine solche Einsichtnahme könnte denn auch unter keinen Umständen gewährt werden, nachdem der Gemeinderat hinsichtlich verschiedener Sachgebiete (z.B. Zivilstands- und Vormundschaftswesen), mit denen er sich zu befassen hat, strengen Geheimhaltungspflichten unterworfen ist. Die vollständige Geheimhaltung wäre nicht mehr gewährleistet, wenn jeder Rechnungsprüfer zu beliebiger Zeit uneingeschränkt in das Ratsprotokoll Einsicht nehmen könnte.
