Zu Recht hat die Obergerichtskommission festgehalten, dass der Regierungsrat zum Erlass der Gerichtskosten gestützt auf Art. 76 sowie in Anlehnung an Art. 1 Abs. 2 der Gebührenordnung für die Rechtspflege vom 28. September 1973 zuständig ist. Der Regierungsrat hat jedoch einen derartigen Kostenerlass stets mit grösster Zurückhaltung ausgesprochen. Einem Gesuch wurde immer nur dann stattgegeben, wenn sich der Gesuchsteller mindestens am Rande des Existenzminimums bewegte, wenn er also richtiggehend arm war. Niemals aber wurde ein Gesuchsteller erhört, der sich nur zu Unrecht verurteilt fühlte.
