Omnilex summary

The Government Council held that, in cantonal administrative proceedings, the right to be heard is satisfied by allowing each party one written submission. A second exchange of briefs and oral pleadings are not provided for under the constant cantonal practice, so the complainant’s request was rejected.

Omnilex headnote

Administrative procedure; right to be heard; second exchange of briefs and oral pleadings. Where constant cantonal administrative practice does not provide for oral hearings, the parties’ right to be heard is satisfied by the opportunity to file one written submission each. Neither a second exchange of briefs nor oral party pleadings is required, absent a specific rule to the contrary.

Verwaltungsverfahren.

Zweiter Schriftenwechsel und mündlicher Parteivortrag.

Entscheid des Regierungsrates vom 20. Juli 1971 (Nr. 412).

Key legal question

Whether a second exchange of briefs and oral party submissions must be allowed in cantonal administrative proceedings.

Extracted holding

No. Under established cantonal administrative practice, the parties are entitled to be heard through one written submission each; a further exchange or oral pleadings are not part of the procedure.

Extracted reasoning

The authority relied on constant cantonal administrative practice, which does not provide for oral hearings in administrative proceedings and satisfies the right to be heard by allowing each party one written submission.
