Art. 5 Abs. 4 VV zum BauG.

Beschwerdelegitimation eines Vereins.

Entscheid des Regierungsrates vom 8. Oktober 1974 (Nr. 611).

Gemäss Art. 5 Abs. 4 zum BauG sind zur öffentlich-rechtlichen Einsprache Personen und Amtsstellen legitimiert, die ein schutzwürdiges Interesse nachweisen. Dieses schutzwürdige Interesse hat im vorliegenden Fall im Rahmen des Baurechts zu bestehen. Der Beschwerdeführer muss also von der Verfügung des Gemeinderates in seiner Rechtsstellung berührt und von einer aktuellen materiellen Benachteiligung betroffen sein (Imboden, Max: Schweizerische Verwaltungsrechtsprechung Band II, 4. Aufl., Basel 1971, S. 672 f.). Dieses Erfordernis trifft für den Rabattsparverein nicht zu. Weder kann der Rabattsparverein darlegen, dass ihn die Immissionen vom angeblich in die falsche Zone zu erstellenden Einkaufszentrum her stören, noch wird er durch den behaupteten gesteigerten Gemeingebrauch der Zufahrtsstrassen belastet. Als unzulässige Kollektiveinsprache kann die Eingabe nicht als Beschwerde im Sinne des Baugesetzes, sondern nur als Aufsichtsbeschwerde entgegen genommen werden. Wenigstens teilweises Eintreten ist jedoch möglich, weil geltend gemacht wird, das Bauvorhaben widerspreche öffentlichen Interessen und verstosse gegen Vorschriften des öffentlichen Rechts.
