A. Le 4 juillet 1996, T. a été condamné par le Tribu-

nal de police du district du Locle à 30 jours d'emprisonnement ferme et

596 francs de frais. Le jugement révoque en outre le sursis accordé à

T. le 19 octobre 1995 par le Tribunal du district de Neuchâtel.

Le jugement attaqué retient que T. s'est rendu cou-

pable d'un vol d'usage, qu'il a conduit le véhicule dérobé alors qu'il

n'était pas au bénéfice d'un permis de conduire, qu'il a perdu la maîtrise

du véhicule alors qu'il circulait en état d'ébriété.

B. Dans son pourvoi daté du 7 octobre 1996, mais posté le 8 octobre

1996 à 18.00 heures, à la poste de Couvet, T. conclut impli-

citement à l'octroi du sursis et, subsidiairement, à pouvoir subir sa

peine à l'Hôpital de Perreux.

C. Le président du Tribunal de police du district du Locle conclut

principalement à l'irrecevabilité du recours, subsidiairement à son rejet.

Le substitut du procureur général conclut au rejet du recours

sans formuler d'observations.

1. Il résulte de l'accusé de réception signé par le recourant que

le jugement du 4 juillet 1996 lui a été remis le 27 septembre 1996.

Le délai de 10 jours prévu par l'article 244 CPPN a commencé à

courir le 28 septembre 1996. Le dernier jour utile pour recourir était le

7 octobre 1996. La date déterminante n'est pas celle que porte le pourvoi

mais bien celle à laquelle il a été déposé au bureau de poste, en l'espèce

le 8 octobre 1996.

Le pourvoi est dès lors tardif et doit être déclaré irrecevable.

2. Il convient en outre d'observer que le pourvoi, même s'il avait

été déposé un jour plus tôt, serait irrecevable dans la mesure où

T. conclut à être autorisé à subir sa peine à l'Hôpital psychiatrique

cantonal de Perreux. En effet, la question de l'exécution de la peine

n'est pas de la compétence de l'autorité judiciaire mais de celle du Dé-

partement de la justice, de la santé et de la sécurité.

3. Le recours étant irrecevable, T. supportera les

frais de justice.
