Mit der Genehmigung des Strassenprojekts wird das Enteignungsrecht erteilt, soweit eine Enteignung zur Erfüllung der Aufgaben aus der Strassenbaulast erforderlich und eine Verständigung nicht möglich ist (§ 77 Abs. 1 StrG). Die für den Erwerb der erforderlichen Rechte zu leistende Entschädigung wird, sofern keine gütliche Einigung zustande kommt, im Schätzungsverfahren nach Enteignungsgesetz festgelegt (§ 77 Abs. 2 StrG). Die Entschädigungsansprüche der betroffenen Grundeigentümer bleiben demnach vorbehalten. Das Enteignungsrecht steht dem Kanton als Träger der Strassenbaulast von Kantonsstrassen zu (§ 33 StrG). Beansprucht der Kanton das Enteignungsrecht, hat er als Enteigner die Kosten des Enteignungsverfahrens zu tragen (§ 87 Abs. 1 lit. a des Enteignungsgesetzes, EntG). Diese Bestimmung gilt nach § 1 EntG für alle Enteignungen, mithin auch für die Erteilung des Enteignungsrechtes nach § 77 Abs. 1 StrG. Der Kanton hat daher die im vorliegenden Projektgenehmigungsverfahren entstandenen Verfahrenskosten, die im Zusammenhang mit der Beurteilung des Enteignungsrechtes für den Ausbau der Kantonsstrasse K I 13 stehen, zu Lasten des Strassenbauvorhabens zu übernehmen. Die Verfahrenskosten bestehen aus den amtlichen Kosten und den Parteikosten (§ 193 Abs. 1 Verwaltungsrechtspflegegesetz, VRG). Den Einsprechern als Enteignete können die auf das Enteignungsverfahren entfallenden Kosten nicht überbunden werden, da ihnen keine mutwillige Prozessführung vorgeworfen werden kann (§ 87 Abs. 2 EntG).
