Andernfalls hat nicht die Verwaltungsbehörde, sondern der Richter zu entscheiden, welche Urkunden die Verwaltungsbehörde herauszugeben hat. In diesem Fall kommen § 152 in Verbindung mit § 160 (Recht zur Aussageverweigerung) und § 164 ZPO (Zeugnispflicht) zur Anwendung. Eine Verweigerung der Edition ist im Rahmen der Beweiswürdigung (§ 143 ZPO) zu berücksichtigen.
