RRE Nr. 178Other CourtFeb 5, 1999Granted

Omnilex summary

The court addressed only the question of appellate jurisdiction over a resolution of a road cooperative concerning the joint construction of subsidized goods roads. It held that, despite the general rule in § 96 LaV referring appeals to the Volkswirtschaftsdepartement, the special provision in § 98 StrG governs and assigns such appeals to the Regierungsrat. The same rule applies to resolutions on subsidized goods roads, because they should not be treated differently from other road-cooperative resolutions under the statute. The administrative appeal was therefore admissible before the Regierungsrat.

Omnilex headnote

§ 96 LaV, § 98 StrG; competence for administrative appeal against resolutions of road cooperatives concerning subsidized goods roads. The special appeal rule of § 98 StrG prevails over the general rule of § 96 LaV. It covers also resolutions on the joint construction of subsidized goods roads, since no reason exists to distinguish them from the other cooperative decisions enumerated in the statute (consid. 1). The objection of lack of competence is therefore unfounded; the Regierungsrat is the competent reviewing authority.

Key legal question

Which authority is competent to hear an administrative appeal against a road cooperative resolution on subsidized goods roads?

Extracted holding

The Regierungsrat is competent; the appeal must therefore be heard.

Extracted reasoning

Although § 96 LaV refers generally to the Volkswirtschaftsdepartement, the Strassengesetz contains a special rule under which appeals against decisions of goods-road cooperatives go to the Regierungsrat. That special rule also covers resolutions on the construction of subsidized goods roads, since there is no reason to treat those decisions differently from the other cooperative resolutions listed in the statute.
