Am letzten Tag der Notfrist übermittelte der Beklagte dem Obergericht um 23.55 Uhr per Telefax eine Kurzbegründung für seine Appellation und stellte die Nachsendung des Originals in Aussicht. Das handschriftlich unterzeichnete Exemplar der Appellationsbegründung ging jedoch beim Obergericht bislang nicht ein.

    • Gemäss ständiger, soweit ersichtlich in der ganzen Schweiz geübter (LGVE 1990 I Nr. 14; PKG 1993 Nr. 43 S. 151ff.; EGVSZ 1990 S. 109 f.) und vom Bundesgericht bestätigter, Praxis der Gerichte gelten Telefax Sendungen nicht als Rechtsschriften, weil es an der eigenhändigen Unterschrift fehlt (vgl. § 69 Abs. 1 ZPO). Gleiches gilt für bloss fotokopierte Unterschriften. Damit wird der Missbrauchsgefahr von kopierten Unterschriften Rechnung getragen (BGE 112 Ia 173, Pra 81 Nr. 26; ZBGR 73 S. 377f.). Diese Praxis wurde im Kanton Luzern zudem im Kantonsblatt Nr. 52/1993, S. 3290, publiziert, wobei ausdrücklich darauf hingewiesen wurde, dass es gesetzlich unzulässig ist, Rechtsschriften und Rechtsmittel an das Obergericht via Telefaxgerät einzureichen.

Aufgrund dessen ist die vom Beklagten per Telefax eingereichte Appellationsbegründung rechtlich unbeachtlich. Ein nachträglich per Post zugestelltes Original müsste als verspätet eingereicht betrachtet werden (§ 88 Abs. 1 ZPO). Die fristgerecht übermittelte, aber unbeachtliche Telefax Sendung ist - ebenso wie eine nicht innert Frist eingereichte Rechtsschrift - nicht verbesserungsfähig im Sinne von § 71 ZPO. Auf die Appellation ist androhungsgemäss nicht einzutreten (§ 249 Abs. 2 ZPO).
