OG 1995 60Other CourtAug 23, 1995Partially Granted

Extracted by Omnilex

Omnilex summary

The accused appealed for state compensation of CHF 2,500 for lost earnings and CHF 8,000 for satisfaction. The appellate court held that these claims had not been shown to have been raised before the Amtsstatthalter and therefore could not be examined for the first time on appeal. It declined to enter into the request and remanded the matter to the competent Amtsstatthalter for processing.

Omnilex headnote

§ 280 Abs. 2 StPO; compensation claims raised for the first time on appeal are inadmissible where they were not previously submitted to the lower authority. The appellate instance is confined by the function of the two-instance system and may only review matters that were already before the authority below. If the record does not show prior submission, the appellate court must decline to enter into the request and remand the matter to the competent lower authority for treatment.

Max. XI Nrn. 375 und 451).

Key legal question

Whether the appellate court may decide on compensation claims for lost earnings and satisfaction raised for the first time on appeal.

Extracted holding

No. The appellate court may only decide on claims that were already submitted to and assessed by the lower authority; otherwise the claims must first be processed by the competent Amtsstatthalter.

Extracted reasoning

This follows from the function of the two-instance system. Since the accused did not show that he had already asserted the claims before the Amtsstatthalter, the appellate court cannot examine them in substance.
