Threshold for opening lawyer disciplinary proceedings

Omnilex summary

The court explains the threshold for commencing disciplinary proceedings against a lawyer. The supervisory authority may act on complaints, reports, or its own findings, but a formal proceeding is justified only where concrete indications create a grounded suspicion of a breach of professional duties. A merely abstract possibility of misconduct is not enough. Because disciplinary law is governed by expediency, the authority may also refrain from proceedings if, in light of all circumstances and the lawyer’s prior conduct, no disciplinary sanction would be appropriate.

Omnilex headnote

§ 11 and § 12 AnwG; § 2 Abs. 2 of the supervisory authority’s rules of procedure: A formal disciplinary proceeding against a lawyer may be initiated only where concrete indications give rise to a substantiated suspicion of a breach of professional or ethical duties. A merely theoretical possibility of misconduct does not suffice. In disciplinary matters the authority retains discretion under the principle of expediency; if, considering the complaint and the lawyer’s previous conduct, no sanction would in any event be indicated, the authority may decline to open proceedings (consid. b).

Sie ahndet u.a. I, Nr. 54 Ziff.

Key legal question

Whether a formal disciplinary proceeding against a reported lawyer should be opened based on the complaint.

Extracted holding

A disciplinary proceeding must be opened only if there are concrete indications and a substantiated suspicion that the lawyer violated professional or ethical duties; a merely conceivable breach is insufficient.

Extracted reasoning

The supervisory authority acts on complaints, reports, or its own findings and may initiate disciplinary action for breaches of professional duties. However, opening proceedings requires a grounded suspicion based on concrete indications. Because disciplinary law follows the principle of expediency, the authority may refrain from proceedings if, considering all circumstances and the lawyer’s prior conduct, no disciplinary measure would be warranted anyway.
