In Fällen, in denen gegen das erstinstanzliche Scheidungsurteil appelliert, der Scheidungspunkt jedoch nicht angefochten wurde, kann eine Teilrechtskraftbescheinigung nur von der Appellationsinstanz aufgrund der Appellations- und Anschlussappellationsanträge ausgestellt werden (vgl. Sträuli/Messmer, Kommentar zur Zürcherischen Zivilprozessordnung, 2. Aufl., Zürich 1982, N 2 zu § 260). Aus dem gleichen Grund hat auch die Meldung der rechtskräftigen Ehescheidung an die Zivilstandsämter der Heimatorte und der schweizerischen Wohnsitze der Ehegatten im Zeitpunkt der Urteilsfällung sowie an die Vormundschaftsbehörde des Wohnsitzes der minderjährigen Kinder (Art. 130 Abs. 1 Ziff. 4 und Abs. 2 ZStV, SR 211.112.1) durch die Appellationsinstanz zu erfolgen. In den übrigen Fällen ist beides Sache der ersten Instanz.
