Die Frage der Teilrechtskraft eines nicht im vollen Umfang angefochtenen erstinstanzlichen Urteils ist der Regelung des kantonalen Prozessrechts überlassen (vgl. BGE 84 II 466 und Bühler/Spühler, Berner Komm., N 30 zu Art. 146 ZGB). Das Obergericht hat vor kurzem seine bisherige Praxis, wonach ein erstinstanzliches Scheidungsurteil in seiner Totalität in der Rechtskraft gehemmt war, selbst wenn sich die Appellation nur auf Nebenpunkte bezog (LGVE 1981 I Nr. 2, Max. VII Nr. 408), geändert. Wie bereits in zahlreichen anderen Kantonen (vgl. z. B. § 260 ZPO ZH, RBOG 1988 Nr. 15, ARGVP 1988 434, SGGVP 1982 Nr. 26; vgl. auch § 245 Abs. 2 und § 113 Abs. 2 des Entwurfs einer neuen Luzerner Zivilprozessordnung) sowie im eidgenössischen Berufungsverfahren (Art. 54 Abs. 2 OG; vgl. auch Art. 149 des Vorentwurfs für eine Revision des eidgenössischen Scheidungsrechts) gilt nun auch im Kanton Luzern, dass mit der blossen Appellationserklärung zunächst die Rechtskraft für das ganze Urteil gehemmt wird, dass aber mit der Stellung der konkreten Appellations- und Anschlussappellationsanträge, d.h. mit deren Eingang beim Obergericht (frühestens aber mit Ablauf der Frist zur Erklärung der Anschlussappellation) der nicht angefochtene Teil des Scheidungsurteils in Rechtskraft erwächst. Das Obergericht wird fortan in einem formellen Beschluss davon Vormerk nehmen.
