In einem Scheidungsprozess appellierten beide Parteien ans Obergericht. Streitig war der Unterhaltsbeitrag des einen an den andern Ehegatten. Die Kinderunterhaltsbeiträge blieben unangefochten.

Aus den Erwägungen:

Grundsätzlich stände aus prozessualer Sicht nichts entgegen, zusammen mit dem Scheidungspunkt auch die Kinderunterhaltsbeiträge in Rechtskraft erwachsen zu lassen. Nun besteht aber bezüglich der Festsetzung von Kinderunterhaltsbeiträgen die uneingeschränkte Offizialmaxime, weshalb das Obergericht diesbezüglich an übereinstimmende Parteianträge nicht gebunden ist und bei Fehlen von Anträgen auch von Amtes wegen tätig werden darf. Da Kinderunterhaltsbeiträge - wie die Praxis zeigt - nicht losgelöst vom Ehegattenbeitrag betrachtet werden können, entginge dem Obergericht ein entscheidender Handlungsspielraum, wenn diese in Teilrechtskraft erwachsen könnten. Der Vorentwurf für ein neues Scheidungsrecht sieht denn auch vor, dass unangefochten gebliebene Kinderunterhaltsbeiträge im Rechtsmittelverfahren neu beurteilt werden können, wenn der Unterhaltsbeitrag des Ehegatten angefochten ist (Art. 149 VE). Nach dem Gesagten ist im vorliegenden Fall davon abzusehen, die Kinderunterhaltsbeiträge in Rechtskraft erwachsen zu lassen.
