Gegen die Einstellung der Untersuchung wegen ungetreuer Geschäftsführung und Verletzung des Bankgeheimnisses kann der Privatkläger, wenn ein Schaden von mindestens Fr. 8000.- entstanden ist oder der Täter einen solchen zufügen wollte, bei der Staatsanwaltschaft Rekurs einlegen mit dem Antrag, dass der Angeschuldigte dem Kriminalgericht überwiesen werde (§ 137 Ziff. 1 i. V. m. § 12 Ziff. 3 und § 16 StPO). Die Privatklägerin hat dem Angeschuldigten J. in ihrer Strafklage vorgeworfen, dem Angeschuldigten P. von den 965 Kreditgeschäften, für die insgesamt Fr. 507 643.35 Provision ausbezahlt worden seien, 338 zu Unrecht, da aus nicht provisionsberechtigten Folgegeschäften entstanden, provisioniert zu haben. Zudem habe er für P. eine Superprovision von Fr. 27 278.- erschwindelt sowie von den ausbezahlten Provisionen aufgrund einer widerrechtlichen Unterbeteiligungsvereinbarung in den Jahren 1983-1988 insgesamt Fr. 191 553.95 erhalten. Mit diesen Behauptungen macht die Privatklägerin einen durch ungetreue Geschäftsführung der Angeschuldigten entstandenen Schaden von weit über Fr. 8 000.- geltend.

Die sachliche Zuständigkeit eines Gerichtes wird durch die Anklage bestimmt (Hauser Robert, Kurzlehrbuch des schweizerischen Strafprozessrechts, 2. Aufl., Basel und Frankfurt 1984, S. 77). Damit ist der vorliegende Fall gemäss § 12 Ziff. 3 StPO erstinstanzlich durch das Kriminalgericht zu beurteilen. Der Amtsstatthalter hat zu Recht in Anwendung der Untersuchungsmaxime (vgl. Widmer Anton, Die Gestaltung des ordentlichen Untersuchungsverfahrens nach der Strafprozessordnung des Kantons Luzern, Diss. Zürich 1979, S. 98) seine Ermittlungen auf sämtliche Kreditvermittlungsgeschäfte sowie die angeblich erschwindelte Superprovision ausgedehnt, obwohl die Privatklägerin lediglich Unterlagen von neun Kreditverhältnissen mit einer Schadenssumme von insgesamt bloss Fr. 6027.22 ediert hatte. Gegen die Einstellung der Untersuchung durch den Entscheid des a.o. Amtsstatthalters, Abteilung Wirtschaftsdelikte, vom 28. März 1990 ist daher tatsächlich nicht der Weiterzug an das zuständige Amtsgericht (§ 137 Ziff. 2 StPO), sondern der Rekurs an die Staatsanwaltschaft mit dem Antrag, dass der Angeschuldigte an das Kriminalgericht überwiesen werde (§ 137 Ziff. 1 StPO), gegeben.
