In einem Befehlsverfahren wurde u. a. die Edition eines Berichtes über die erfolgte Zustellung einer Einschreibesendung beantragt. Dazu wurde ausgeführt:

"Vorsorglich" hat die Klägerin noch die Edition "eines Berichtes über die Zustellung . . ." beantragt. Unter Hinweis auf die klägerische Angabe, sie werde sich um eine Postbestätigung selber bemühen, ist dieser Antrag zum vornherein unbeachtlich. Es kommt hinzu, dass im (summarischen) Befehlsverfahren in der Regel nur der Beweis durch Urkunden und Parteibefragung zugelassen ist. Ein Editionsverfahren nach §§ 148 ff. ZPO für eine Urkunde, die sich der Beweisbelastete problemlos selber beschaffen kann, ist jedenfalls ausgeschlossen. Wer somit im Summarverfahren als Beweisbelasteter eine von ihm selber beschaffbare Urkunde nicht auflegt, hat die Folgen der Beweislosigkeit zu tragen (Kummer, Berner Kommentar, N 36 zu Art. 8 ZGB).
