Omnilex summary

The court waived court costs in the legal-aid proceedings, including the review and appeal stages, because both parties were granted legal aid. However, it ordered the plaintiff to bear the opposing party's appeal attorney fees. The reason was that the plaintiff had failed to present and substantiate the wage garnishment, health-insurance premiums, outside meal costs, and the inability to generate side income from taxi driving before the first-instance judge, although this would have avoided the appeal. The promised proof of pension-fund payment was not submitted.

Omnilex headnote

§ 237 i.V.m. § 119 Abs. 1 ZPO; legal aid and court costs in UR proceedings: where legal aid is granted to both parties, no court costs are charged for the main proceedings and the review/appeal stages. By contrast, pursuant to § 237 i.V.m. § 120 Abs. 1 ZPO, the party who failed to satisfy its duty of cooperation and substantiation in the first instance may be ordered to bear the opposing party's appeal attorney fees personally, especially where the decisive means of support could and should already have been asserted and proven earlier (consid. X).

R.S.; BGE 111 Ia 104 E. 2 lit. b).
