Mit Entscheid vom 3. Juli 1997 wies der Amtsstatthalter eine Privatklage als verspätet von der Hand. Den dagegen eingereichten Rekurs wies die Staatsanwaltschaft ab. In diesem Zusammenhang übermittelte sie dem Obergericht ein bei ihr vom Privatkläger eingereichtes "Revisionsgesuch". Die Staatsanwaltschaft verneinte die Revisionsfähigkeit des angefochtenen Vonderhandweisungsentscheides. Das Obergericht stützte diese Auffassung mit folgender Begründung:

Gegenstand der Revision nach § 255 StPO können grundsätzlich nur rechtskräftige Urteile sein. Der Vonderhandweisungsentscheid gemäss § 59 StPO kann nicht als revisionsfähiges Urteil im Sinne von § 255 StPO betrachtet werden, weil bei dieser Art der Erledigung der Strafsache keine materiellen Erwägungen angestellt wurden. Bei der Vonderhandweisung wird einer Strafanzeige oder Strafklage wegen fehlender Strafverfolgungsvoraussetzungen oder mangelnder konkreter Verdachtsmomente von vorneherein keine Folge geleistet (vgl. Schmid Niklaus, Strafprozessrecht, Zürich 1993, 2. Aufl., S. 336 f., N 1141; Hauser/Schweri, Schweizerisches Strafprozessrecht, 3. Aufl., Basel und Frankfurt 1997, S. 337, N 24 zu § 79).
