in der verwaltungsrechtlichen Streitsache

betreffend öffentliche Unterstützung

1. Gemäss Art. 48 des Gesetzes über die Verwaltungsrechtspflege (VRG; BR 370.100) kann das Verwaltungsgericht ein Urteil im Dispositiv ohne Begründung oder mit einer Kurzbegründung mitteilen. Bei Verzicht auf ein vollständig begründetes Urteil wird die Staatsgebühr angemessen reduziert (Art. 75 Abs. 2 letzter Satz VRG).

2. Im vorliegenden Fall wird auf eine ausführliche Begründung des Urteils verzichtet. Von der Beschwerdeführerin wird geltend gemacht, die Beschwerdegegnerin habe die Wohnkosten in Höhe von Fr. 1'150.-- so lange zu übernehmen, bis sie eine günstigere Wohnung in der Gemeinde … gefunden habe, welche Platz für sie, ihren Sohn sowie ihre Haustiere biete und in welcher sie für ihren älteren Sohn einen Schlafplatz einrichten könne. Dem kann nicht gefolgt werden. Am 24. Januar 2006 erliess die Gemeinde ein Mietzinsreglement, wonach die Mietzinsen samt Wohnnebenkosten für Familien und Alleinerziehende mit einem Kind bis zu einem Maximalbetrag von Fr. 1'150.-- mitfinanziert werden. Der Beschwerdeführerin ist seit März 2006 bekannt, dass die von ihr und ihrem Sohn bewohnte 5-Zimmerwohnung den gewährten Maximalmietzins überschreitet, was ihr denn auch mit Verfügung vom 16. März 2006 sowie mit Schreiben vom 31. März 2006 mitgeteilt wurde. Die Gemeinde verhielt sich in dieser Zeit äusserst entgegenkommend und erklärte sich bereit, im Rahmen einer Übergangsregelung die Wohnkosten bis 30. September 2006 weiterhin mit Fr. 1'295.-- anzurechnen. Selbstverständlich war es der Beschwerdeführerin in der Folge unbenommen, den ungedeckten Betrag aus dem Grundbetrag zu bezahlen. Sie durfte sich indessen nicht darauf verlassen, dass sie dies auf unbestimmte Zeit würde tun können. Dass die Beschwerdegegnerin bereits am 23. September 2008 ein neues Mietzinsreglement erlassen hat, mag aus Gründen der Rechtssicherheit zwar etwas störend anmuten, ist jedoch angesichts der angeführten Gründe für den Systemwechsel überzeugend und im Ergebnis deshalb nicht zu beanstanden. Mit Verfügung vom 30. Oktober 2008 bzw. mit korrigierter Verfügung vom 15. Januar 2009 wurde der Beschwerdeführerin mitgeteilt, dass der Mietzins von Fr. 1'150.-- bis 31. März 2009 gewährt und ab 1. April 2009 der angepasste Maximalmietzins von Fr. 950.-- angerechnet werde. Ihr wurde somit eine ausreichend lange Übergangsfrist eingeräumt, um in dieser Zeit in eine günstigere Wohnung umziehen zu können. Nach Art. 8 der Ausführungsbestimmungen zum kantonalen Unterstützungsgesetz (ABzUG; BR 546.270) sind überhöhte Wohnkosten nur bis zum nächsten Kündigungstermin, maximal jedoch während sechs Monaten, zu übernehmen. Vorliegend gilt es auch zu berücksichtigen, dass die Beschwerdeführerin - wie bereits erwähnt - schon längere Zeit um die Situation wusste, sich bis anhin jedoch kaum um eine Alternative kümmerte. Angesichts der persönlichen Verhältnisse der Beschwerdeführerin erscheint im vorliegenden Fall eine 3- bis 3½-Zimmerwohnung angemessen. Wie die Beschwerdegegnerin belegt, bietet der Wohnungsmarkt in der Gemeinde denn auch genügend günstigen und zumutbaren Wohnraum. Ein Wegzug in eine andere Gemeinde wird nicht verlangt und wäre aufgrund der Verhältnisse wohl auch nicht zumutbar. Gesamthaft betrachtet wäre es der Beschwerdeführerin somit zumutbar gewesen, den Mietvertrag Ende Dezember 2008 per 31. März 2009 - auch ohne effektiv verfügbare Alternative - zu kündigen und sich in der Zwischenzeit nach einer günstigeren Wohnung umzusehen. Die Beschwerde erweist sich demnach als unbegründet, weshalb sie abzuweisen ist.

Demnach erkennt das Gericht:

1. Die Beschwerde wird abgewiesen.

2. Es werden keine Gerichtskosten erhoben.

3. a) Jede Partei kann innert 30 Tagen seit der Mitteilung schriftlich ein vollständig begründetes Urteil verlangen. Verlangt keine Partei innert Frist eine Begründung, erwächst das Urteil in Rechtskraft.

b) Verlangt eine Partei eine Begründung, wird der Entscheid schriftlich begründet und den Parteien in vollständiger Ausfertigung mitgeteilt. Die Rechtsmittelfristen beginnen mit dieser Zustellung zu laufen. Mit dem begründeten Urteil wird auch die vollumfängliche Staatsgebühr von Fr. 300.-- erhoben.
